- AML Guardian is a RegTech software platform designed to help Tranche 2 entities (real estate agents, lawyers, accountants, trust service providers) implement their own AML/CTF programs.
- Syntrico does not accept responsibility for clients’ regulatory compliance outcomes.
- Client Responsibilities
- Your business remains fully responsible for:
- Designing, implementing, and maintaining your AML/CTF program
- Conducting ML/TF risk assessments
- Performing Customer Due Diligence (CDD), Enhanced CDD (ECDD), Ongoing Monitoring
- Meeting all Suspicious Matter Reporting (SMR), Threshold Transaction Reports (TTR), and other reporting obligations
- Ensuring all program elements meet “reasonable grounds” tests under AML/CTF Act s36
- No Liability
- Syntrico accepts no liability for fines, penalties, enforcement actions, or compliance failures resulting from use of AML Guardian.
- Clients indemnify Syntrico against claims arising from incorrect configuration, data input errors, or failure to follow platform workflows.
- Data & Privacy
- All customer data processed through AML Guardian remains the property of the reporting entity.
- Syntrico complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
- Data is hosted on secure Australian servers with enterprise-grade encryption.
- Platform Limitations
- AML Guardian supports Tranche 2 compliance workflows but:
- Does not guarantee AUSTRAC acceptance of your program
- Requires client oversight of all screening results and decisions
- PEP/Sanctions/Adverse Media screening uses third-party data sources (accuracy not guaranteed 100%)
- Legislative Changes
- AML/CTF rules and Tranche 2 reforms (effective 1 July 2026) are subject to change.
- Syntrico will update AML Guardian for known legislative changes but cannot predict future AUSTRAC guidance.
