New businesses entering the AUSTRAC regulation

2026 – obligations commence
$31M+
Maximum penalty per breach for companies
Australia is entering one of the most significant shifts in its financial crime prevention landscape since the original AML/CTF Act came into effect. With Tranche 2 reforms commencing 1 July 2026, businesses across legal, accounting, real estate and corporate services will for the first time fall under AUSTRAC’s regulatory umbrella.
The anxiety across these industries is understandable. But acting out of fear leads to rushed decisions, wasted money and ineffective programs. The real advantage goes to those who prepare early, calmly, and with the right information.
| The Bottom Line These reforms are not about catching businesses out. They’re about closing the financial crime gaps that global watchdogs like FATF have flagged for years, and bringing Australia in line with the UK, EU and US, where these obligations have existed for decades. |
Who Must Comply?
From 1 July 2026, AML/CTF obligations apply to businesses providing designated services in these sectors:
- Real estate agents
- Buyer’s agents
- Property developers
- Accountants & tax agents
- Auditors
- Lawyers & solicitors
- Conveyancers
- Trust & company service providers
- Precious metals dealers
- Virtual asset services
Not sure if you’re regulated?
Use AUSTRAC’s online “Check if you may be regulated” . If you provide services that involve client transactions in these sectors, you almost certainly are.

4. Conduct KYC/KYB and ongoing monitoring – verify all clients before providing designated services. Retain records for a minimum of 7 years.
5. Report, train, and stay audit-ready – submit Suspicious Matter Reports (SMRs) within 3 business days. Train all staff. Keep meticulous records.
Don’t Scramble – Build it Once, Build it Right
Businesses that treat Tranche 2 as a genuine operational capability, not a last-minute checkbox, will come ahead. The benefits are real: faster client onboarding, stronger reputational positioning, and a defensible audit trail if AUSTRAC ever comes knocking.
AUSTRAC’s approach to new entrants
AUSTRAC has been clear that its enforcement posture toward newly regulated businesses will be pragmatic and proportionate. They reward documented effort and good faith, not perfection. Starting now, even imperfectly, is far better than waiting.
