Do Buyer's Agents need to Enrol with AUSTRAC?

Whether you are just starting or running an established buyer agency, getting AUSTRAC compliance wrong can lead to serious penalties.

Understanding AUSTRAC and its role in Property Transactions

AUSTRAC – the Australian Transaction Reports and Analysis Centre – is Australia’s financial intelligence unit and anti-money laundering regulator. The agency fights money laundering, terrorism financing, and other serious financial crimes that threaten Australia’s economy and security. It operates as both a regulatory body and an intelligence agency, collecting and analysing financial data, enforcing compliance, and providing intelligence to law enforcement.

Real estate has long been recognised as a sector at high risk of money laundering due to the high-value nature of property transactions and the potential for anonymity in ownership structures. The AML/CTF Amendment Act – the most significant reform to Australia’s anti-money laundering framework in nearly two decades – now formally brings the entire real estate sector, including buyer’s agents, into scope.

AUSTRAC Enrolment Requirements: Who Must Comply

Buyer’s Agents are now Squarely in Scope

This is the most important update in this guide. Under the AML/CTF Amendment Act, buyer’s agents and buyer’s advocates are explicitly regulated as reporting entities. Assisting a client to plan or execute the purchase of real property is a designated service under the Act, with no exemptions for buyer’s agents.

Buyer’s agents are often the first professionals to interact with a purchaser, including overseas investors, making them a natural checkpoint for identifying money laundering risk before funds are committed to a transaction.

By 1 July 2026, every buyer’s agent providing designated services must:

  1. Enrol with AUSTRAC – Enrolment opened 31 March 2026 and must be completed by 29 July 2026.
  1. Develop an AML/CTF Program – A written, risk-based program documenting your policies, procedures, and controls to manage money laundering and terrorism financing risks.
  1. Appoint a Compliance Officer – Someone at management level, typically the owner or principal for small agencies. AUSTRAC must be notified by 29 July 2026.
  1. Conduct Customer Due Diligence (CDD) – Verify the identity of clients before providing services, including beneficial owners of corporate purchasers.
  1. Report Suspicious Matters – Submit suspicious matter reports (SMRs) when transactions may involve money laundering or terrorism financing.
  1. Retain Records for Seven Years – All compliance records, transaction documentation, and customer identification records must be kept for a minimum of seven years.

Penalties for Non-Compliance with AUSTRAC

Non-compliance with AUSTRAC obligations is not a minor administrative oversight. These are enforceable legal obligations, not optional guidelines. AUSTRAC has broad powers to impose significant civil penalties – up to $2.2 million per breach for businesses, or three times the benefit obtained, whichever is greater. In the most serious cases, criminal penalties, including up to 10 years’ imprisonment, apply. These are enforceable legal obligations, not optional guidelines. With the 1st July 2026 deadline now weeks away, buyer’s agents who haven’t started the compliance process need to treat this as urgent.

How Syntrico helps Buyer’s Agents Get Compliant – Without the Complexity
