Tranche 2 AML/CTF Reforms: Don’t Act Out of Fear – Act with a Plan

2026 – obligations commence

$31M+

Maximum penalty per breach for companies

The Bottom Line These reforms are not about catching businesses out. They’re about closing the financial crime gaps that global watchdogs like FATF have flagged for years, and bringing Australia in line with the UK, EU and US, where these obligations have existed for decades.

Who Must Comply?

From 1 July 2026, AML/CTF obligations apply to businesses providing designated services in these sectors:

  • Real estate agents
  • Buyer’s agents
  • Property developers
  • Accountants & tax agents
  • Auditors
  • Lawyers & solicitors
  • Conveyancers
  • Trust & company service providers
  • Precious metals dealers
  • Virtual asset services

Not sure if you’re regulated?

Your 5 Core Obligations Under Tranche 2

1. Enrol with AUSTRAC and appoint a compliance officer. Enrolment opens 31 March 2026, deadline 29 July 2026.

2. Complete an ML/TF risk assessment, formally document your exposure across service lines, client types and channels.

3. Build an AML/CTF program, covering policies, procedures, governance and review schedules.

4. Conduct KYC/KYB and ongoing monitoring – verify all clients before providing designated services. Retain records for a minimum of 7 years.

5. Report, train, and stay audit-ready – submit Suspicious Matter Reports (SMRs) within 3 business days. Train all staff. Keep meticulous records.

Don’t Scramble – Build it Once, Build it Right

Businesses that treat Tranche 2 as a genuine operational capability, not a last-minute checkbox, will come ahead. The benefits are real: faster client onboarding, stronger reputational positioning, and a defensible audit trail if AUSTRAC ever comes knocking.

AUSTRAC’s approach to new entrants

AUSTRAC has been clear that its enforcement posture toward newly regulated businesses will be pragmatic and proportionate. They reward documented effort and good faith, not perfection. Starting now, even imperfectly, is far better than waiting.
